| 1. | Price & payment |
| 1.1 | The prices displayed include GST at the current rate. |
| 1.2 | We reserve the right to adjust the price before delivery to reflect any unforeseen cost increases. |
| 1.3 | Payment of goods constitutes acceptance of our terms and conditions as outlined in this document. |
| 1.4 | Goods remain the property of Yaku Nursery until payment is received in full. |
| 1.5 | Late fees can be incurred as per our terms of trade. |
| 2. | Delivery |
| 2.1 | We may deliver your order as part deliveries. |
| 2.2 | If you refuse delivery of the goods, we may charge you for the cost of the delivery. |
| 2.3 | If you accept a delivery of a damaged box, we cannot be held responsible for any damage to what is inside, once the goods have been signed for. |
| 2.4 | Acceptance of delivery constitutes acceptance of our terms and conditions as outlined. |
| 2.5 | Yaku Nursery is not responsible for the misrouting of boxes by the courier, which can result in the delivery being made later than expected. |
| 3. | Refunds/replacements |
| 3.1 | If you wish to return any items purchased from us you must give us notice within 7 days of receipt. |
| 3.2 | All returns must be returned at your cost within 14 days of receipt. |
| 3.3 | Payment for the returned goods will be refunded within 30 days of the goods being received by us, less the postage charges. |
| 3.4 | Every effort is made to ensure that our plants are correctly named and of the highest quality. However neglect, poor planting conditions, adverse weather conditions and damage by animals could lead to plants failing. It is therefore impossible for us to consider complaints fourteen days after purchase. If there is anything wrong with any plant on arrival, we need to be contacted immediately so we can deal with it |
| 3.5 | Plants will be replaced at our discretion on the understanding that the whole plant is returned with the label, inside 14 days. |
| 3.6 | The descriptions and photographs on this website are intended as a guide only. Planting varieties under different conditions and climates can affect colour, height and flowering. Feeding also plays a big part in this. |
